Drafting a Rental Agreement — What You Need to Know

A good rental agreement is not a formality — it is practical protection for both parties. A landlord who signs a defective contract may find themselves unable to evict a tenant, unable to deduct for damages, and waiving rights they did not know they had. A tenant who signs without a review may encounter clauses that allow the landlord to increase rent, enter at any time, or refuse to return the deposit.

From the landlord's perspective: A good contract will include a clear definition of the tenant's liability for damage, a fast-track eviction mechanism upon breach, conditions for renewal and rent increases, and a prohibition on subletting without consent.

From the tenant's perspective: Ensure there are no unreasonable restrictions on use of the apartment, that the deposit is protected (escrow / separate account), that early exit conditions are defined, and that the landlord is responsible for defects and malfunctions beyond normal wear and tear.

Tenant Eviction — How Does It Work?

A tenant who has not vacated after the tenancy period ended, who is not paying rent, or who is in breach of the contract's terms — can be evicted through legal proceedings. You must not attempt to evict a tenant by force or cut off electricity and water — this is prohibited and may expose you to damages claims.

The stages: (1) A formal warning letter from an attorney — often sufficient to achieve a quick resolution; (2) Filing an eviction and rent debt claim in court; (3) Receiving a judgment and applying to the Enforcement Office for physical eviction. The average process takes 3–6 months — a contract that includes expedited eviction clauses can shorten this.
