Heads of Damage — What Can Be Claimed

A personal injury claim is based on defined heads of damage — each head of damage is calculated separately and accumulates into the total compensation. The main heads: temporary disability (during the treatment period) and permanent disability (after a stable condition is determined), pain and suffering, lost wages, medical expenses, and assistance from others.

Lost wages are usually the highest head of damage — calculated according to the difference between the income the victim would have earned without the injury and what they are capable of earning afterwards, multiplied by the remaining working years. For a young victim, the amount can reach millions.

Assistance from others covers the cost of help the victim requires — even if provided by family members without payment. The court calculates the cost as if a paid caregiver were employed, and compensates accordingly.

How Each Head of Damage Is Calculated

Disability: Disability is determined by a medical expert — initially the victim's own expert (and sometimes also the insurance company's). The expert sets a functional and medical disability percentage according to defined criteria. The disability percentage directly affects the level of compensation.

Pain and suffering: Calculated according to court tables — a starting point based on age and disability percentage, plus personal considerations. A young person with significant disability receives far higher compensation than an older person with the same disability.

Future expenses: Future medical expenses and assistance from others are calculated based on a medical opinion — how many treatments will be needed, what they cost, and for how many years they will continue. This amount is discounted to its present value.

Settlement vs. Ruling — Which Is Better

Settlement provides certainty — you know exactly how much you receive, and faster. A ruling provides the possibility of higher compensation — but entails risk, time, and costs. The decision depends on the size of the offer, the complexity of the case, and the client's preferences.
