Child Support 2026 — Guide to Calculation and Rights

Child support is a legal obligation that cannot be waived — it is possible to agree on a different amount than what a court would order, but not to waive support entirely. Support is the child's right, not the parent's, and is therefore specially protected by law.
The 2017 Kanti Ruling changed the rules: before it, the father was obligated to pay child support even if he was the non-custodial parent. Today, child support is calculated based on both parents' income — a significant change that affects thousands of cases every year.
Important to know: support arrears can be enforced aggressively through the enforcement office — salary attachment, bank account, pension, passport revocation, and more. Do not assume that court-ordered support payments can be avoided.

Israel has not set a uniform table for calculating support — the amount is determined in each case according to its circumstances. The main calculation factors are: the child's needs (age, health status, education), net income of both parents, custody arrangements (joint custody lowers support), and number of children.
“Determining income” for support calculation is generally net income from all sources — employment, self-employment, rental income, allowances. The court can calculate “potential income” if either party is not working at maximum capacity.
The Kanti Ruling divides the cost of raising the child between both parents proportionally to their income. For example: if the father earns 60% of the combined income, he pays 60% of the child-rearing cost (minus his custody days). This change was very significant compared to the old method.
Filing a Support Claim and Enforcement
A support claim is filed with the Family Court. It is possible to simultaneously request temporary support — which can take effect almost immediately and provide financial protection throughout the proceedings. The attorney will prepare all required documents: pay slips, bank statements, documentation of the child's expenses.
When court-ordered support is not paid, an enforcement file is opened. Enforcement proceedings allow: salary attachment of up to one-third; bank account attachment; pension and savings account attachment; passport and driver's license revocation; and even imprisonment in serious circumstances.
Arrears (past unpaid support) accumulate as a debt with interest and can be enforced even years after they were ordered. Do not negotiate support without legal advice — a waiver that appears “fair” may be very difficult to change later.
Modifying Support — When and How
Support ordered by a court can be modified when a “material change in circumstances” has occurred: one parent received a significant promotion, was laid off, began living with a new partner, the other parent's income increased significantly, custody arrangements changed, or the child reached an age that changes the support obligation.
The modification request is filed with the same court that ordered the original support. It is important to gather evidence of the change in circumstances and file a reasoned petition. The attorney will help build the case and present it in a way that persuades the court.
