Tort lawyers in Israel typically work on a success-fee (Dmei Hatzlacha) basis — they are paid a percentage of what you recover, and nothing if you do not win.

What Affects the Success Fee

Strength of the case — A case with clear liability and documented damage allows a lower percentage. A case where liability is disputed or evidence is weak requires a higher percentage to justify the risk.
Type of claim — Medical malpractice is the most complex and expensive to prove, hence the higher percentage. Road accident no-fault claims are simpler, hence lower percentages.
Anticipated recovery amount — For large claims, lawyers may agree to a lower percentage because the total is still significant. For small claims, the percentage may be higher.
Disbursements — Expert reports, court fees, and other out-of-pocket expenses may be handled separately. Clarify from the outset who pays for these and how.
