A prenuptial agreement (in Hebrew: Heskhem Mamon) allows a couple to determine in advance how their assets will be divided if the marriage ends in divorce. In Israel, where property disputes in divorce proceedings can be prolonged and costly, a well-drafted prenuptial agreement can save both parties significant stress and expense.

Despite common misconceptions, a prenuptial agreement is not a sign of distrust — it is a mature financial planning tool used by couples across all backgrounds.

How Much Does It Cost?

Basic agreement (before marriage)₪2,000–4,500

Note: each party should have their own independent legal representation. This is not just recommended — courts scrutinise agreements where one party was unrepresented. Both legal fees are typically included in the total cost quoted by each party's lawyer.

What Can Be Included

  • Separation of property — assets each party brings to the marriage remain theirs separately
  • How future acquisitions during the marriage will be treated
  • Treatment of gifts and inheritances received during the marriage
  • Division of a specific property (e.g., a home one party owned before marriage)
  • Protection of a family business from division
  • Financial support arrangements in case of divorce
  • How pension rights accrued before the marriage are treated

What Cannot Be Included

  • Child custody or visitation arrangements — courts decide these based on the child's best interests at the time
  • Child maintenance — minimum legal requirements cannot be waived
  • Provisions that violate public policy or good morals
  • Provisions that are clearly unconscionable or create extreme unfairness
  • Any provision obtained by fraud, duress, or undue influence

When It Makes Sense

One party enters the marriage with significant assets — A home, inheritance, business, or investment portfolio. Without an agreement, these may become subject to division on divorce.
One party has significant debts — Protecting the other party from potential liability.
Second marriage with children from a previous relationship — Ensuring assets are preserved for children from a previous marriage is a common and legitimate concern.
Family business — Preventing a business built over generations from being subject to divorce-related division.
